If you are an accredited Olympian and have a valid OLYMPIAN.ORG Free User Account and use the OLYMPIAN.ORG web site you agree to be bound by the following terms and conditions ('Terms of Use').

 

Basic Terms:

  1. You must be an accredited Olympic Athlete.
  2. You are responsible for any activity that occurs under your user name.
  3. You are responsible for keeping your password secure.
  4. You must not abuse, harass, threaten, impersonate or intimidate other OLYMPIAN.ORG users.
  5. You may not use the OLYMPIAN.ORG service for any illegal or unauthorized purpose. Olympian users outside the United States of America agree to comply with all local laws regarding online conduct and acceptable content.
  6. You shall be completely and solely responsible for your own content submissions within the social network and the consequences of posing or publishing them. In connection with the content submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize OLYMPIAN.ORG to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all user content submissions to enable inclusion and use of the submissions in the manner contemplated by the website and these terms and conditions.
  7. In connection with the user content submissions, you agree that you will not submit material, including video and music, that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, for the purposes of commercial sales other than private use, unless you are the owner of such rights or have permission from their rightful owner to post and submit the material and to grant OLYMPIAN.ORG all of the license rights granted herein.
  8. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ('Content')that you submit, post, and display on the OLYMPIAN.ORG  social network service.
  9. OLYMPIAN.ORG is intended for personal use and it is not intended to provide a complex business solution. Professional or corporate uses of OLYMPIAN.ORG are at your own risk.
  10. You must not modify, adapt or hack OLYMPIAN.ORG or modify another website so as to falsely imply that it is associated with OLYMPIAN.ORG.
  11. You must not create or submit unwanted email to any OLYMPIAN.ORG members ('Spam').
  12. You must not transmit any worms or viruses or any code of a destructive nature.
  13. You must not, in the use of OLYMPIAN.ORG violate any laws in your jurisdiction (including but not limited to copyright laws).
  14. Any loss of, or damage to, data is not the responsibility of OLYMPIAN.ORG. Use of this service is at your own risk.
  15. IN NO EVENT SHALL OLYMPIAN.ORG or its Licensor IAMSPORT HOLDING GROUP , ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY
    (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT,
    (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE,

    (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE MYFIRSTSINGLE.COM WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

    YOU SPECIFICALLY ACKNOWLEDGE THAT OLYMPIAN.ORG SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

    The Website, Mail Server and Social Network is controlled and managed by PARADOX from its facilities in the Netherlands Antilles and The United States of America. OLYMPIAN.ORG makes no representations that the OLYMPIAN.ORG Website is appropriate or available for use in other locations. Those who access or use the OLYMPIAN.ORG Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

  16. You agree to defend, indemnify and hold harmless OLYMPIAN.ORG, its parent corporation, IAMSPORT HOLDINGS GROUP, its associated companies, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
    (i) your use of and access to the     OLYMPIAN.ORG Website and Social Network;
    (ii) your violation of any term of these Terms and Conditions;
    (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or
    (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms and Conditions and your use of the     OLYMPIAN.ORG Website.

    Violation of any of these agreements will result in the termination of your OLYMPIAN.ORG account. While OLYMPIAN.ORG prohibits such conduct and content on its site, you understand and agree that OLYMPIAN.ORG cannot be responsible for the Content posted on its web site and, despite our best efforts, may be exposed to such materials and that you use the OLYMPIAN.ORG service at your own risk.
